1.1. The Refer a Friend Program is a way for Izwe Savings and Loans PLC (“Izwe”) clients to earn rewards by referring their friends to apply for a loan with Izwe using their unique referral code according to these Terms and Conditions (“Terms”). The referred friends can also earn rewards if they successfully take out a loan with Izwe according to these Terms.
1.2. By participating in the Refer a Friend Program you acknowledge that you have read and understood these Terms and agree to be bound hereby. By agreeing to these Terms you represent and warrant that you are at least the age of majority in Ghana and are legally capable of entering into a binding contract.
1.3. If you do not agree with any of these Terms you may not participate in the Refer a Friend Program.
1.4. Izwe may amend, supplement or vary these Terms at its sole discretion and such amendment, supplement or variation shall be binding on participants. An updated version of the Terms will be made available on Izwe’s website (www.izweghana.com) and/or any other medium that Izwe may choose from time to time. On publication of an updated version of these Terms on Izwe’s website and/or any other medium, participants will be deemed to have read same and consented to all changes to the Terms.
1.5. In the event that you do not accept any changes made by Izwe to these Terms, you must not participate further in the Refer a Friend Program.
2.1 The Refer a Friend Program is open to all existing Izwe clients with an active account.
2.2 Any breach or attempted breach of any of these Terms will result in immediate disqualification from participation in the Refer a Friend Program.
2.3 Izwe reserves the right to reject or cancel a Refer a Friend referral for any reason at its discretion and, in particular, if it is suspected that there has been any misuse of the Refer a Friend Program in any way.
2.4 The Refer a Friend Program is only intended for Izwe clients to refer their friends and family and the program cannot be used by businesses or individuals for lead generation or posted on discount sites.
2.1. Izwe independent sales executives, super agents and employees are not eligible to participate in the Refer a Friend Program.
3. How the Refer a Friend Program Works
3.1. Izwe clients can earn rewards by referring their friends to apply for a loan with Izwe. In addition, the referred friend can earn rewards if they successfully take out a loan with Izwe and pay their first loan instalment on time.
3.2. Izwe clients will receive a unique referral code by SMS that they can share with their friends for purposes of the Refer a Friend Program.
3.3. There is no limit to how many friends a participant can refer. Referred friends will however need to be new clients to Izwe in order for participants to be eligible to receive rewards.
3.4. The referred friend must provide the referrer’s unique referral code when applying for a loan with Izwe. Once a code has been provided to Izwe, it cannot be changed to another code. Multiple participants can invite the same friend, however only one unique referral code can be used when the referred friend applies for a loan.
3.5. Referral codes will not be accepted after a new client has obtained a loan, or in any form other than by providing the unique referral code during the loan application process.
3.6. The referred friend must successfully obtain a loan from Izwe and duly pay the first loan instalment on time for both the referrer and referred friend to be eligible to get rewarded. Izwe shall have absolute discretion to reject any referred friend’s loan application without assigning any reason therefor.
4. How to Refer a Friend
4.1. Izwe will send its existing eligible clients a unique referral code by SMS that can be used for purposes of the Refer a Friend Program.
4.2. If you do not receive the SMS with your unique referral code or have forgotten it any time you can call the Izwe Customer Care Contact Centre on 0302 208222 to obtain your unique referral code.
4.3. The method to generate a unique referral code may be changed by Izwe without notice to participants.
4.4. Participants can refer friends by sharing their unique referral code which must be provided to Izwe by the referred friend when applying for a loan with Izwe.
4.5. Participants can also share the referral link with friends via instant messaging or social media platforms where the referred friend will be guided to follow a step-by-step process.
4.6. Participants will be notified if their referred friend uses their unique referral code to successfully apply for a loan eligible for rewards with Izwe.
5. Refer a Friend Program Rewards
5.1. Izwe clients who refer their friends to apply for a loan with Izwe using their unique referral code can earn the following rewards should the referred friend successfully apply for a loan of a minimum of GHS5,000 with Izwe and pay their first loan instalment on time:
5.1.1. GHS500 for successful personal loan or business loan referral;
5.1.2. GHS300 for a successful payroll loan referral.
5.2. In addition, referred friends who successfully apply for a loan of a minimum of GHS5,000 with Izwe using the referrer’s unique referral code and pay their first loan instalment on time can earn a cash back of their first instalment paid.
5.3. Refer a Friend rewards will only to be paid to participants provided the referred friend successfully applies for a loan of a minimum of GHS5,000 with Izwe and pays the first loan instalment on time.
5.4. If the referred friend takes out a loan of less than GHS5,000 or does not make payment of the first loan instalment on time, no rewards will be payable.
5.5. Refer a Friend rewards payments will be made by EFT or via the MoMo payment method. Izwe reserves the right to change the Refer a Friend rewards and/or payment methods at its discretion at any time without notice to participants.
6. Tax liability
6.1. Participants are responsible for any and all tax liabilities associated with their participation in the Refer a Friend Program and receipt of rewards and Izwe will have no responsibility in respect thereof.
6.2. Participants hereby indemnify Izwe from and against all taxes of whatever nature and wheresoever arising which may be payable by the participants (or claimed by any authority to be payable) in respect of any rewards they may get in terms of the Refer a Friend Program.
6.3. Participants must get their own tax advice about any rewards they may get in terms of the Refer a Friend Program.
7. Compliance with Laws
7.1. As a participant, you agree to comply with all applicable data protection laws and regulations, including but not limited to the Data Protection Act 2012 (Act 843). Any distribution of your unique referral code and/or the referral link that could constitute unsolicited commercial email or “spam” under any applicable law or regulation is expressly prohibited and will be grounds for immediate termination of your participation from the Refer a Friend Program and forfeiture of any rewards you may have received in terms hereof.
8. Termination of Participation from the Refer a Friend Program
8.1. Izwe reserves the right to terminate a participant’s right to participate in the Refer a Friend Program with immediate effect in the event that:
8.1.1. the participant commits fraud or is suspected to have done so;
8.1.2. where Izwe is under the impression that a participant’s conduct was inappropriate or constitutes misconduct, misuse of the program or is prohibited as detailed herein;
8.1.3. if the participant breaches these Terms;
8.1.4. if the law requires Izwe to do so.
8.2. In instances where a participant’s right to participate in the Refer a Friend Program is terminated by Izwe on the above grounds Izwe reserves the right to recoup any rewards paid to such participants.
9. Cancellation of the Refer a Friend Program
9.1. Izwe reserves the right to cancel the Refer a Friend Program at any time without notice to participants.
9.2. If the Refer a Friend Program is cancelled for any reason whatsoever, any unpaid rewards will be forfeited at that time. Participants accept that they will have no recourse against Izwe to the extent permitted by law.
10. Governing Law and Dispute Resolution
10.1. These Terms will be governed by and construed in accordance with the laws of Ghana.
10.2. Participants may contact Izwe through the Izwe Customer Care Contact Centre on 0302 208222 or by email to email@example.com to report any dispute arising out of or in connection with the Refer a Friend Program including without limitation, any dispute as to the existence, scope, interpretation, validity, default or enforceability of these Terms.
10.3. Any dispute which cannot be resolved by the Izwe Customer Care Contact Centre will be submitted to a single arbitrator and decided by arbitration in terms of the Alternative Dispute Resolution Act 2010 (Act 798) of the laws of Ghana, which arbitration will be conducted at the Ghana Arbitration Centre, Accra, Ghana and the language of the arbitration will be in English.
10.4. The above provisions will not prohibit or restrict any party from applying for any urgent or mandatory relief from any court or competent jurisdiction.
11.1. Izwe may give notices under these Terms, in writing by email, hand-delivery or by post to the last address provided by participants. In addition, Izwe may publish notices of general nature, which are applicable to all participants, on its website and such notices will have the same effect as a notice served individually to a participant.
12. General Provisions
12.1. Failure of Izwe to insist upon the performance of any Term, or to exercise any rights herein, will not be construed as a waiver or relinquishment of the future performance of any such Term, or the future exercise of any such right, and the obligations of the participant with respect to such future performance will continue in full force and effect.
12.2. If any of the provisions of these Terms are determined by any competent authority to be invalid, unlawful or unenforceable, such provision will to that extent be severed from the remaining terms and conditions, which will continue to be valid and enforceable to the fullest extent permitted by law.
12.3. Subject to applicable law, Izwe will not under any circumstances be liable to compensate participants or any third parties for any losses or damages occurring as a result of participation in the Refer a Friend Program.
